NPA Head Adv Andy Mothibi says his focus is to restore the integrity of the office
The National Prosecuting Authority (NPA) is a crucial institution in any democratic country. Its role is to uphold the rule of law and ensure that justice is served. However, in recent years, the NPA has faced numerous challenges that have threatened its integrity. But now, there is a new man at the helm, Adv Andy Mothibi, and he has made it his mission to restore the integrity of the office.
Adv Mothibi was appointed as the new National Director of Public Prosecutions (NDPP) in October 2020, after serving as the head of the Special Investigating Unit (SIU). He took over from Advocate Shamila Batohi, who had been in the position for two years. Adv Mothibi’s appointment came at a crucial time when the NPA was facing scrutiny and criticism for its handling of high-profile cases.
In his first media briefing as the NDPP, Adv Mothibi made it clear that his main focus is to restore the integrity and credibility of the NPA. He acknowledged that there have been challenges in the past, but he is determined to turn things around. He stated, “I am under no illusion that there are challenges in the NPA, but I am also confident that we can overcome them and restore the integrity of this office.”
One of the main challenges that Adv Mothibi will have to address is the perception that the NPA is politically influenced. This perception has been fueled by the handling of cases involving high-ranking politicians and influential individuals. Adv Mothibi stressed that the NPA will operate independently, without any political interference. He said, “The NPA must be independent and must be seen to be independent. There will be no room for political interference in our work.”
Another challenge that Adv Mothibi has identified is the lack of resources and capacity within the NPA. He plans to tackle this issue by working closely with the Department of Justice and other government entities to ensure that the NPA has the necessary resources to effectively carry out its duties. He also intends to invest in training and development programs to enhance the skills of NPA staff.
Adv Mothibi’s appointment has also brought renewed hope for the NPA’s collaboration with law enforcement agencies. He has emphasized the importance of working together with the South African Police Service (SAPS), the Hawks, and other agencies to ensure that criminals are brought to justice. He said, “We have to work together to achieve the common goal of a safe and just society for all.”
The NPA has also been criticized for its slow pace in finalizing cases, which has resulted in a significant backlog. Adv Mothibi has assured the public that he will prioritize the speedy resolution of cases, especially those involving corruption and state capture. He has also promised to strengthen the Asset Forfeiture Unit to ensure that ill-gotten gains are recovered and returned to the state.
Adv Mothibi’s determination to restore the integrity of the NPA has been met with positive responses from various stakeholders. The South African Police Union (SAPU) has expressed its support for Adv Mothibi, stating that they believe he is the right person to lead the NPA and bring about the necessary changes. The South African Society of Advocates (SASA) also welcomed his appointment, stating that they have confidence in his abilities to lead the NPA.
In conclusion, Adv Andy Mothibi’s appointment as the new NDPP has brought a renewed sense of hope for the NPA and the South African justice system. His focus on restoring the integrity of the office and working towards a corruption-free country is commendable. With his determination, leadership, and collaboration with other institutions, we can expect to see positive changes and a stronger NPA in the near future. Let us support and trust Adv Mothibi as he takes on this important task of restoring the NPA’s integrity and upholding the rule of law in our nation.
